1. Who are we?

Entelec Control Systems, with registered office at Wetenschapspark 25, 3590 Diepenbeek, Belgium, and VAT number BE 0543.803.378, acts as controller  for the processing described below.

2. What categories of personal data do we collect?

Depending on your role, we collect the following data:

  • Customers, prospects and suppliers: general identification information (such as name, position, address, telephone number, email, company information) and other information you provide.
  • Applicants: data such as a CV and/or application letter.
  • Website visitors: data collected via cookies (see our cookie policy) (website: www.entelec.eu).
  • Social media users: data used for marketing through social media channels.


In the course of its activities, Entelec Control Systems also acts as a processor of personal data (for example, processing user data through Entelec products and applications). The processing of personal data by Entelec Control Systems, as a processor, is part of the agreements between Entelec and the data controller(s) and is not covered by this privacy policy.


If you provide us with personal data of a third party, such as your employees, freelancers, customers, suppliers, or partners, you guarantee to Entelec Control Systems that you:


(a) have lawfully obtained such personal data from the third party and have lawfully provided it to
Entelec.
(b) have provided personal data that is accurate and up to date.
(c) have informed the relevant person about the existence and content of this policy.


3. What do we use your personal data for?

  1. Execution of agreements: such as creating an account, invoicing, customer service and deliveries.
  2. Direct marketing: sending newsletters and marketing offers (unsubscribe possible via opt-out at the bottom of the email).
  3. Management of job applicants.
  4. Improving our services: To improve and optimize our services (including through cookies and advertisements via social media), to maintain and enhance the website (including through cookies), to ensure the security of our website and services, to prevent misuse or improper use of our services, to retain personal data as evidence or for judicial, administrative, or extrajudicial proceedings, to store personal data for the purpose of obtaining or maintaining insurance coverage, managing risks, or seeking professional advice.
  5. Compliance with legal obligations, such as anti-money laundering regulations.
  6. In general: you are not required to share your personal data with us. However, if you choose not to provide the requested personal data, we may not be able to deliver the desired services and/or products to you.


4. Legal basis for processing your data

The processing of:

  • Personal data under section 3.1 is based on the performance of a contract to which the data subject is a party or in order to take steps at the request of the data subject before entering into a contract.
  • Personal data of prospects under section 3.2 and the processing of personal data through cookies (other than strictly necessary and functional cookies) under section 3.4 is based on the consent of the data subject.
  • Personal data of prospects under section 3.2 for customers and the initial contact with prospects, as well as other processing of personal data under sections 3.3 and 3.4, is based on our legitimate interests (only when our company's legitimate interest outweighs the interests of the data subjects). These interests are outlined in sections 3.2 - 3.4.
  • Personal data under section 3.5 is necessary to comply with a legal obligation to which we are subject.


5. How do we protect your data?

Entelec Control Systems is certified according to the ISO 27001 standard.


Reliable Partners

We only entrust the processing of your data to a reliable partner who provides the necessary written assurances that they will process the data in accordance with the requirements of this Privacy Policy and privacy regulations.


Technical Security Measures

These measures include access security (login procedures, password policies, role distribution, etc.), storage security (encryption, backups, etc.), and protection against external access (firewall, antivirus software, etc.) for the media on which personal data is stored.


Organizational Measures

This involves raising awareness among employees and service providers about the importance of privacy, enforcing policies, maintaining a data register, adhering to a data policy, and more.


Despite the security measures we implement, please be aware that data transmission over an internet connection is never entirely risk-free. Therefore, when using the internet, you should take the necessary precautions to protect yourself against viruses, malware, and other threats.


6. With who do we share your data with?

We only share relevant aspects of personal data with third parties if those parties are contractually bound to Entelec Control Systems or act on behalf of or under contract with Entelec Control Systems. Naturally, we have agreements in place with these parties regarding the protection of your personal data.


However, we may disclose your personal data when such disclosure is necessary to comply with a legal obligation to which we are subject or to protect your (crucial) interests. We may also disclose your personal data when such disclosure is necessary to establish, exercise, or defend legal claims in judicial, administrative, or extrajudicial proceedings.


We do not transfer personal data to companies outside the European Economic Area unless there is an adequacy decision or standard contractual clauses, appropriate safeguards, binding corporate rules, or exchanges as referred to in Article 49(1) of the GDPR.


In the event of a full or partial reorganization, merger, demerger, acquisition, or sale of assets, we are entitled to transfer personal data to the relevant third party.


You acknowledge that any personal data you submit for publication via our website or services may be available worldwide via the internet. We cannot prevent the use (or misuse) of such personal information by others.


7. How long do we retain your data?

Your data will not be retained for longer than is necessary for the above-mentioned purposes and in accordance with statutory retention periods.


8. Your rights

You have the following rights with respect to your personal data:

  • Right of access: You can request which personal data we process about you.
  • Right to correction: You can have incorrect data corrected.
  • Right to erasure: You can request that your data be erased if there is no legal obligation to retain it.
  • Right to restriction of processing: You can request to temporarily restrict processing.
  • Right to data portability: You can request to receive your data in a structured format.
  • Right to object to processing:  You have the right to object at any time to our processing of your personal data for direct marketing purposes. Practically, you can do this via the 'opt-out' option. Afterward, you will no longer receive unwanted direct marketing messages, and we will no longer process your personal data for these direct marketing purposes. Of course, it is still possible that we may contact you in connection with the performance of the agreement.

Additionally, you have the right to object to our processing of your personal data for scientific, historical, or statistical (research) purposes for reasons related to your specific situation, unless the processing is necessary for the performance of a task carried out for reasons of public interest.
